Welcome to Fizzydo. This website and its associated services are owned and operated by Buckinghams Media. By accessing our website, browsing our blog or directory, or completing a purchase or subscription via Stripe or BACS, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must cease using our platform immediately.

1. The Fizzydo Directory & Platform Role

  • Intermediary Platform: Fizzydo is an online marketing, directory, and blog platform providing promotional services for businesses and professionals. We act strictly as a marketing platform promoting local businesses to couples. We do not provide services directly, nor do we act as an employer, agent, or contractor for any listed member.

  • No Endorsement: We do not vet, verify, endorse, or guarantee the ongoing services, reliability, performance, or financial standing of any third-party business listed in our directory.

  • Self-certification: Our onboarding process represents self-certification by the supplier rather than a formal endorsement, recommendation, vetting process, or guarantee of service by Fizzydo. Our full platform disclaimer can be viewed at www.fizzydo.co.uk/standards.

  • Trading Status & Insolvency: Business members are entirely responsible for updating or removing their listing immediately if their business ceases trading, enters administration, or closes down. Fizzydo does not monitor or guarantee the ongoing financial solvency, trading status, or commercial stability of any member. Fizzydo accepts absolutely no liability for financial losses, lost deposits, or disruptions resulting from a listed business closing down or going out of business.

  • Independent Contracts: Any contract or arrangement formed for services is strictly between the couple and the respective supplier. Fizzydo is not a party to, or liable for, any disputes, cancellations, or financial losses arising from these external agreements.

  • Accuracy of Member Information, Offers & Availability: Fizzydo publishes and displays information, blog posts, promotional offers, date availability, and events provided directly by our members. While we require our members to keep their details accurate and current, Fizzydo is not responsible or liable for any outdated information, misinformation, or discrepancies regarding a member's pricing, promotional offers, event dates, availability, deposit requirements, or business policies.

2. Supplier Eligibility & Verification

  • Invitation-Only Network: Membership to the Fizzydo Network is strictly by invitation only. Submitting an application questionnaire does not guarantee acceptance or a listing. We manually review all submissions to ensure members align with our standards. We reserve the absolute right to decline any application without providing a reason.

  • Lawful Operation: All directory members confirm they are a legitimate business operating lawfully and are registered for UK tax purposes where required.

  • Insurance Requirements: Members confirm they hold valid Public Liability Insurance appropriate to their services and agree to provide physical proof of coverage upon request.

  • Food Hygiene Standards: Food and drink suppliers explicitly confirm they are registered with Environmental Health and maintain a minimum Food Hygiene Rating of 5 where applicable.

  • Right to Audit: We reserve the right to request business verification documentation at any time. Failure to provide requested proofs may result in account suspension or removal without refund.

3. Member Conduct & Reputational Protections

  • Professional Standards: Members agree to act professionally, honestly, and lawfully at all times when interacting with clients or other professionals on our platform or at our events.

  • Unfair Competition: Members must not misuse Fizzydo or Buckinghams Media platforms, digital spaces, directories, or physical events to solicit or divert business inappropriately, or to compete unfairly with other members or ourselves.

  • Third-Party Promotion Restrictions: Members are prohibited from using our digital platforms, directory listings, or physical event stands to advertise, promote, or display branding for rival directories, competing media platforms, or external event organisers.

  • Reputational Protection: We reserve the right to suspend or remove any member profile or user account without refund where conduct is deemed harmful, disruptive, or damaging to the brand reputation or commercial interests of Fizzydo or Buckinghams Media.

  • Equality and Inclusion: Members agree to comply fully with the Equality Act 2010. Fizzydo operates a strict non-discrimination policy. We reserve the right to immediately suspend or terminate any directory listing or event booking, without liability or refund, if a member refuses service, improperly restricts access, or uses discriminatory language based on race, religion, sex, sexual orientation, disability, age, or gender identity.

4. Membership, Billing & Stripe Cancellation

  • Monthly Membership: Billed via Stripe on a rolling monthly basis. Monthly plans may be cancelled by contacting our Member Manager in writing. Cancellation requests must be received in writing at least one (1) calendar month before the next scheduled billing date to allow for manual processing and prevent the next automated charge. No refunds will be issued for any billing period that has already been processed.

  • Annual Membership: Billed upfront for a 12-month term. No pro-rata or partial refunds are available for early cancellation. Membership remains active until the end of the agreed term. Membership will automatically renew for successive 12-month periods via Stripe unless cancelled in writing by contacting our Member Manager at least 30 days before the annual renewal date. At the time of renewal, members may choose to switch to a monthly plan if they prefer.

  • Pricing Changes: We reserve the right to update pricing at any time. Members will receive at least 30 days’ advance notice of any changes.

  • Pricing & Payments: You can choose a monthly or annual membership option. All payments are processed securely via Stripe (supporting credit/debit cards and Apple Pay) or BACS transfer. We do not store or have access to your full payment card details.

  • Benefit Protection (Clawback Policy): Where monthly paying members receive promotional member benefits, or discounts, and cancel their membership within twelve (12) months of receiving that benefit, no contract lock-in applies. However, the member agrees to pay back the difference between the member pricing and standard non-member pricing, or the full retail value of the services delivered, before the cancellation is finalised.

  • Breach of Conduct Refunds: If a membership or event booking is cancelled or terminated by Buckinghams Media due to a breach of our Member Conduct rules (Section 3), any refund issued is entirely at our absolute discretion. Where a discretionary refund is granted, we reserve the right to deduct and retain the full retail value of any promotional benefits or discounts used, an administration fee of £50, and any non-recoverable payment processing fees charged to us by Stripe.

  • Membership Commencement & Content Deadlines: Your subscription and billing cycle begin immediately upon payment. It is your responsibility to provide your onboarding text, Public Liability Insurance (PLI), and imagery. If you fail to submit your content, your membership remains active and your billing continues regardless. No refunds or billing pauses will be granted for delayed content submissions.

5. Content Rights, Listings & Media Licensing

  • Account Responsibility: You are solely responsible for all content, information, text, and imagery submitted under your account. All content must be legal, accurate, and not misleading.

  • Editorial Control: We reserve the right to edit content for formatting, clarity, SEO optimisation, or presentation purposes without altering its core meaning. Stock imagery must not be used in a misleading way to represent actual services. While Fizzydo makes every reasonable effort to credit photographers and suppliers as provided by the submitter, we rely entirely on the accuracy of the information supplied and accept absolutely no liability for any unintentional omissions, typos, or misattributions.

  • Photographer Copyright Warranty: Members confirm they own or have explicit legal permission to use all submitted content and that it does not infringe any third-party intellectual property rights.

  • Third-Party Rights Warranty & Indemnity: You explicitly warrant that all content, information, logos, designs, audio, and imagery submitted under your account do not violate any third-party privacy rights, trademarks, patents, design rights, or copyrights. You agree to fully indemnify, defend, and hold harmless Buckinghams Media and its partners against any and all legal claims, damages, statutory liabilities, and legal costs arising directly out of a third-party claim that your submitted media or business information infringes upon their intellectual property or legal rights.

  • Grant of License: By submitting content, you grant Buckinghams Media a non-exclusive, worldwide, royalty-free, perpetual licence to use, publish, reproduce, edit, and distribute your content across digital and print platforms for marketing, editorial, and promotional purposes.

6. Content Submission Terms

These terms apply to all content submitted for publication, including blog features, listings, and general third party submissions:

  • Age & Consents: You confirm that you are at least 18 years old, that you own or have permission for all submitted content, and that all necessary consents have been obtained.

  • Model Releases: You confirm that all necessary permissions and consents have been obtained for any identifiable individuals featured in submitted content, including couples, guests, and third parties. Where children or minors are identifiable, you confirm that appropriate parental or guardian consent has been obtained. Where consent cannot be demonstrated, we reserve the right to refuse, remove, or restrict use of the content across any platform, including digital and print.

  • Publication Discretion: Submission does not guarantee publication. We reserve the right to edit, select, or reject submissions at our discretion and may remove published content at any time.

  • Exclusivity Window: If exclusivity is explicitly agreed, content may not be published elsewhere for 90 days following publication on Fizzydo unless otherwise agreed in writing.

7. Consumer & Couple Submissions (User-Generated Content)

If you are a member of the public submitting your own personal content (such as an engagement announcement, love story, or image for our public galleries) rather than a professional industry submission:

  • Partner Consent: You warrant that you have obtained the full consent of your partner, and any other identifiable person featured or named in your submission, to publish their images, names, or initials publicly on our platform.

  • Non-Exclusivity: Section 6 (90-day Exclusivity) does not apply to you. You remain completely free to share your personal photos and stories elsewhere.

  • Right to Withdraw: You retain the right to request the removal of your personal content from our website at any time by emailing info@fizzydo.co.uk. We will process digital removals within 14 working days.

  • Print Exemption: Where content has been used in printed materials (including physical magazines, brochures, or publications), removal requests will apply only to future digital use and cannot apply retrospectively to printed materials that have already been produced or distributed.

8. General Website Use & Prohibited Scraping

  • Intellectual Property: All material, text, graphics, logos, branding, website design, layout, and software code on www.fizzydo.co.uk are the property of Buckinghams Media or our licensors and are protected by UK copyright laws.

  • Permitted Use: Visitors are granted a limited, non-exclusive, revocable license to view and share links to our content for personal, non-commercial purposes.

    Prohibited Scraping: You must not use automated systems, software, or "robots" to extract, scrape, or harvest data, supplier listings, email addresses, or imagery from this website for commercial use or compilation into alternative directories.

9. Liability, Privacy & Governing Law

  • Limitation of Liability: To the fullest extent permitted by law, Buckinghams Media shall not be liable for any indirect, incidental, or consequential losses, including loss of profit, loss of business, or disruptions.

  • Financial Liability Cap: Our aggregate financial liability to any directory member or user for all claims, losses, or damages arising under or in connection with these Terms - whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise - shall be strictly limited to the total membership fees actually paid by that specific member to Fizzydo during the twelve (12) months immediately preceding the event that gave rise to the liability.

  • Statutory Protections: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded or limited.

  • Privacy Policy: We process personal data in accordance with our Privacy Policy.

  • Changes to These Terms: We may update these Terms from time to time. Continued use of our website or directory services constitutes acceptance of any updated terms.

  • Governing Law: These Terms are governed by the laws of England and Wales, and subject to the exclusive jurisdiction of the English courts.
